Terms of sale

1. Who we are

Commercial Components (Midlands) Ltd, registered in England and Wales, company number 09042860. Registered office: 3 Durrant Road, Bournemouth BH2 6NE. Trading address: Unit 30 Sandy Way, Amington Industrial Estate, Tamworth, Staffordshire B77 4DS. VAT number GB 186 7447 59. Contact: 01827 426426, Tamworth@commercialcomponentsmidlands.co.uk.

2. Your order and when it is accepted

Our website shows what we sell; it is not an offer to sell. When you place an order you are offering to buy. We will email to say we have received it. That email is not acceptance. A contract only exists when we email to confirm your order is being dispatched or is ready to collect.

3. Our right to decline or cancel an order

Before we accept your order, we may decline it, or part of it, if:

  • the part is no longer available from us or our suppliers, or stock was shown wrongly;
  • the price or description on our website was wrong;
  • we cannot confirm the part fits your vehicle, or cannot verify your identity, address or payment;
  • we suspect fraud, misuse or a breach of these terms;
  • a trade order would take the account over its credit limit, or the account is overdue, on hold or closed.

If we decline an order we will tell you as soon as we can and refund any payment in full, usually within 5 working days. If we find a problem after acceptance, for example a supplier cannot supply, we will tell you, offer an alternative if we have one, or cancel and refund you in full.

4. Prices and payment

Prices are in pounds. All prices on our website are shown without VAT. VAT and delivery are added at checkout. Delivery is shown at checkout. If a price was clearly wrong, we will contact you before accepting the order. Card payments are taken when you order; trade account orders are invoiced under your account terms.

5. Fitting and suitability

Our advisors may contact you for your registration to check a part. You are responsible for the part being fitted by a competent person and for checking it against the vehicle before fitting.

6. Delivery, risk and ownership

Risk passes to you on delivery or collection. Parts remain ours until paid for in full.

7. Cancelling and returns

See Returns and refunds. Nothing in these terms affects your rights under the Consumer Rights Act 2015.

8. Your website account

Keep your login details safe and tell us about any unauthorised use. We may suspend or close a website account if: information given is false; the account is used fraudulently or abusively; these terms are seriously or repeatedly broken; or it has not been used for 12 months. We will tell you why, unless the law or a fraud investigation prevents it. Closing an account does not cancel accepted orders or money owed.

9. Liability

We are responsible for loss that is a foreseeable result of our breaking these terms. For business customers, we are not liable for loss of profit, business or downtime, and our total liability for an order is limited to its price. We do not limit liability where the law does not allow it, including for death or personal injury caused by negligence, or fraud.

10. Law

These terms are governed by the law of England and Wales. Consumers in Scotland or Northern Ireland may also bring claims in their local courts.
